Can a public notary and the seal before signing an affidavit of service when no other firm in the form?
I have a statement affidavit of service that is signed and stamped by a notary public, but no other signature on the form. There is a place to put a signature with a name, but thats all.Looks as the person performing the service has not signed a court it.Will allow this?
I am a notary public. A notary may only rubber-stamp and sign a document that has witnessed the signature of the person whose signature appears on the document. A notary can not authenticate his signature. In some cases, and in some states, a notary can serve court papers and then make a return of service with his signature on the document. Depending on your state, this * may * be what is happening. Otherwise, if there is a space where there should be a signature, and there is a notary seal and signature, I send a copy of the document to the Secretary of State's office in your state. Regulate (usually) the appointment of Notaries Public.
